Foreign Cause as a Means of Preventing Civil Responsibility to the Estate Registrar in English Law and Iraqi Law

Abstract

We mentioned in this paper the foreign cause, which is one of the most important means used to pay responsibility in general, whether at the civil, criminal or administrative level, as after the civil Responsibility of the real estate registrar is achieved as a result of the error issued by him, which in turn led to the damage of the customer, some cases may arise that in turn lead to the payment of responsibility for the registrar, including the foreign cause in all its forms of force majeure and emergency circumstance or the act of others Or the fault of the injured party himself, as after fulfilling the conditions that must be met in it, the matter leads to severing the causal relationship between the fault of the registrar and the damage of the injured party, and as a result the responsibility of the real estate registrar is negated
