Current State and Suggestions for Preventing Juvenile Delinquency in the Face of Judicial Reforms and State Re-Organization

Abstract: Juvenile delinquency is an ongoing problem in Vietnam. While there is a legal framework available, there are still many inadequacies in the current provisions of criminal law and the institutional framework itself for preventing juvenile delinquency. Through analyzing the clauses of the Vietnamese Penal Code and subsequent Resolutions meant to supplement it, the article will expose those inadequacies and propose comprehensive policy recommendations. These suggestions will prove necessary moving forward, especially in the greater context of sweeping judicial reforms in Resolution No. 49-NQ/TW and the Strategy for Building a Socialist Rule-of-Law State. Furthermore, the article introduces a cross-sectoral organizational mechanism for juvenile crime prevention in accordance with the new administrative structure to be implemented from July 1, 2025. This article is expected to provide lawmakers with new ideas on how to improve legal framework while bringing more insight to the general public on the ongoing issues with preventing juvenile delinquency.
